Q. What are the different penalties between first degree criminal sexual conduct, second degree criminal sexual conduct, third degree criminal sexual conduct and fourth degree criminal sexual conduct?

A. First degree criminal sexual conduct: Up to life in prison, many times a 25 mandatory minimum sentence to prison. Electronic lifetime monitoring is also possible pursuant to the statute and registration on the sex offender registry.

Second degree criminal sexual conduct: Up to 15 years in prison and registration on the sex offender registry.

Third degree criminal sexual conduct: Up to 15 years in prison and registration on the sex offender registry.

Fourth degree criminal sexual conduct: Up to two years in prison; If the charge is amended to be an attempted criminal sexual conduct 4, this is a misdemeanor punishable by up to one year in prison. 4th degree criminal sexual conduct and attempted 4th degree criminal sexual conduct require registration on the sex offender registry.
